I- BACKGROUND The UN Convention on the Rights of the Child (CRC) was unanimously adopted by the United Nations General Assembly on 20 th November 1989 and entered into effect on 2 nd September 1990. It is a comprehensive instrument made up of 54 articles, which sets out the rights that define universal principles and norms for children, taking into account their need for special assistance and protection due to their status and vulnerability. By ratifying the CRC, a State takes on legal obligations to protect, respect and fulfil those rights for all children within its jurisdiction. The CRC is not only the first international human rights treaty to include civil, political, economic, social and cultural rights, but it is also the most widely ratified international human rights treaty. The near universal ratification of the CRC provides the foundation for improving the situation of children around the world. Yet, millions of children are far from being able to claim and enjoy their rights. Worse still, for many children the violation of their rights happens on a daily basis. The Kingdom of Cambodia ratified the CRC in 1992 and consequently is obliged to report on its compliance with theCRC. The Initial report of States parties was submitted to the Committee on the Rights of the Child (the Committee) on 18 th December 1997 and the 2 nd and 3 rd Periodic Report of States parties was submitted to the Committee on 12 th March 2009. Following the due date from the Committee, the Kingdom of Cambodia will submit their 4 th , 5 th and 6 th Periodic Report of States Parties on 13 th May 2018. The Committee is composed of eighteen independent experts whoare elected by States parties to the CRC. The Committee members serve in their personal capacity for four-year terms and can be re-elected. The CRC requires that Committee members have “high moral standing and recognized competence in the field covered by this Convention” (art. 43(2)). An equitable geographical distribution and representation of the principal legal systems is taken into consideration in their election. II- RATIONAL: Article 44 of the CRC sets up the periodic reporting mechanism of States parties, noting that a State party must submit an initial report to the Committee two years after it ratifies the CRC and it enters into effect in the respective State, and then every five years thereafter. The submission date for subsequent periodic reports is set out in the last paragraph of the Concluding Observations, 2 which are adopted by the Committee and sent to the State following each review. Given that the Committee often has a backlog of reports to review, the date set in the Concluding Observations is the relevant date to follow to find out when the country’s next report is officially due. While it is States that have the legal obligation to report on and implement the CRC, achieving the change we are seeking for all children demands the engagement of society as a whole, including NGOs, National Human Rights Institutions (NHRIs) and children themselves. One of the ways each of these actors can contribute to change is by reporting to the Committee on the Rights of the Child when their State is being reviewed. By presenting an alternative report, these actors can give their perspective on the situation facing children at national level and the measures which the State needs to take to fulfill its obligation to uphold children’s rights. Reports shall contain sufficient information to provide the Committee with a comprehensive understanding of the implementation of the Convention in Cambodia. However, the UN Human Rights system can seem inaccessible for many national civil society actors. This is where the role of Child Rights Connect (formerly the NGO Group for the Convention on the Rights of the Child) comes into play. 3 Reporting to the Committee can be integrated into a broader strategy for NGOs and NHRIs conducting ongoing monitoring and advocacy for the improvement of child rights in a State. Effective engagement with the Committee’s reporting process provides an important opportunity to harness the power of the international human rights system to reinforce advocacy messages and affect change for the advancement of child rights at national level. This work does take time and resources and it is important for NGOs and NHRIs to consider how to incorporate these activities into their current advocacy work using the resources available to them. III- OVERALL OBJECTIVE: To contribute to hold government accountability to respect, protect and fulfil the Child Rights in Cambodia through reinforcing the implementation of both national legislative frameworks to be compliant with the CRC. IV- SPECIFIC OBJECTIVES: The objective of this consultancy is to develop an Alternative Report on the Implementation of the CRC in Cambodia 2008-2018. The Alternative Report will provide the accurate and objective information and data independent from the State Report for the Committee’s understanding of the situation of children’s rights in Cambodia at the time of the review. IV- DELIVERABLES: - Submission of Inception Report which include the research methodologies, timeframe or work plan - Submission of the fieldwork report based on field data collection and the field researches of the five Thematic Working Groups - Submission of the Alternative Report on Child Rights Implementation 2008-2018 to CRC-Cambodia and the Committee based on their guideline and deadline (in Khmer and English); - Submission of the policy-brief based on the factual finding of the Alternative Report 2008-2018 IV- METHODOLOGY: The assignment is required to conduct certain methods as below: - Collect and conduct a review: of available data from State Report on the Implementation of the CRC 2008-2018, CRC-Cambodia’s Online Child Rights Monitoring System, the Annual Child Rights Situation Analysis, and other information to accurately identify trends, patterns, incidence and causes of key deprivations (e.g. child mortality, stunting, low levels of birth registration, low school enrolment and achievement or violence against children), disaggregated by relevant segments of the population. - Support the Five Thematic Working Group (TWGs) to collect data/information by using the Online Child Rights Monitoring System in selected provinces to indicate the progress have been made by relevant stakeholders to promote children’s rights in Cambodia, identify gaps of the implementation and strategic and policy recommendations. - Key Informant Interview with CRC-Cambodia’s members, CSOs working to to indicate the progress have been made by relevant stakeholders to promote children’s rights in Cambodia, identify gaps of the implementation and strategic and policy recommendations. - Consultation Workshops at sub-national level: At least three consultation workshops will conduct with children groups, children and youth networks, and other CSOs to validate data and explore and identify trends, patterns, incidence and causes of general trends of children’s situation. - Conduct a national finalization workshops: At least two dissemination workshop will conduct with children groups, children and youth networks, CSOs, and other development partners to disseminate and improve the understanding of decision-makers, partners and all other stakeholders of the current status of children’s rights in the country and the causes of shortfalls and inequities, as the basis for recommending actions. - Submit the Alternative Report on Child Rights Implementation 2008-2018 to CRC-Cambodia and the Committee based on their guideline and deadline (in Khmer and English); V- SCOPE OF WORK: The design and implementation of the mapping the strategic and advocacy framework must also take into account and abide by key principles of the Convention on the Rights of the Children and the requirements and guidelines of the CRC Reporting process. The Alternative Report 2008-2018 will be developed respectively for children groups, children and youth networks, CRC-Cambodia’s Members and other relevant partners. A rights-based, equity-focused the Alternative Report on the Implementation of the CRC in Cambodia 2008-2018 should seek to respond to the following questions, either through direct consideration, or through reference to other documents in which these are adequately addressed: ** Key mapping questions: - What are the progress of the implementation of recommendations from the Committee in previous concluding observations? - What are the emerging issues and the urgent issues to making progress on the recommendations from previous concluding observations? - How do child and maternal outcomes and trends differ across population groups and regions? - Which are the most deprived groups of children and women? Where are they located? - What forms of deprivation and exclusion do these groups face? What are the determining factors that give rise to and perpetuate their exclusion? - What are the underlying causes of gender and other inequalities across population groups and regions? - What are the immediate, underlying and structural barriers and roadblocks to child and maternal well-being and to accessing and utilizing basic social services and other critical resources? - What risks (conflict, natural hazards, etc.) exist that are likely to affect the patterns of deprivation and exclusion, exacerbate or create barriers and bottlenecks? - What existing social, institutional and political factors (e.g. social norms, institutional capacities at all levels of government, accountability and coordination mechanisms, policy and legal frameworks) impede or could potentially support the creation of an enabling environment for the realization of children’s rights? - What programme interventions and resource mobilization and allocation options should be considered in the future, in order to address specific dimensions of inequality and pervasive vulnerabilities? - What other recommendations should be considered in order to make a significant progress on previous commitments? - It is proposed to start the work in 1 st September 2018, with the total consultancy 65 working days. It is strongly suggested to finalise it by 30 th March 2019.The main task of consultant: - Meet with CRC-Cambodia’s Staff and task force team to prepare the mapping and collection (1 days) - Conduct Desk review and meet with CRC-Cambodia’s staff and Technical Working Group to develop the incept report and inform to the development of the Alternative Report on the Implementation of the CRC in Cambodia 2008-2018 (10 days) - Conduct field consultations with Children and Youth Networks, CRC-Cambodia’s members, and other Children’s Rights Focused Organizations to collect inputs and feedbacks on what knowledge about the trends, patterns, incidence and causes contributing to general trends of children’s situations in Cambodia (10 days) - Support the Five Thematic Working Group (TWGs) to collect data/information by using the Online Child Rights Monitoring System in selected provinces to indicate the progress have been made by relevant stakeholders to promote children’s rights in Cambodia, identify gaps of the implementation and strategic and policy recommendations (10 days) - Extract and analysis the data from the CRC-Cambodia’s Online Child Rights Monitoring System (4 days) - Meeting with relevant stakeholders a CSOs actors and Child and Youth-Led Networks to explore and identify trends, patterns, incidences and causes of general trends of children’s situation (5 days) - Compile the draft of the Alternative Report on the Implementation of the CRC in Cambodia 2008-2018 (15 days) - Conduct consultation workshops with NGO coalitions, CRC-Cambodia’s staff, Children and Youth, international NGOs, UN Agencies working on draft Alternative Report on the Implementation of the CRC in Cambodia 2008-2018 (3 days) - Conduct finalization workshops and finalise the Alternative Report on the Implementation of the CRC in Cambodia 2008-2018 in both English and Khmer version including matrix of the supporting documents (5 days) - Support to submit the Alternative Report on the Implementation of the CRC in Cambodia 2008-2018 to the Committee based on their guidelines and deadlines (2 days) VI- CONSULTANT QUALIFICATION: One credible independent person (local and/or international) consultant will be recruited. The minimum qualifications and experience required are: - At least a Master’s Degree in Social Sciences, Development Studies, MDS - Knowledge and experience of Cambodian situation, other Asian countries and UN Human Rights Mechanism and System will be an asset; - Proven experience in conducting the researches and analytical studies and reports as well as have sound knowledge of Children’s Rights, Child Participation, community base child protection and child participation mechanism at different level and development; - Sound experiences of developing and evaluating the key quality element of child rights, child participation and child protection; - Experience of developing the programs/projects and action plan for governments and CSOs related to child participation; - Conversant with application of cross cutting themes like gender and disabilities mainstreaming and monitoring and valuation skills; - Good spoken and written communication skills in English; - Excellent analytical and report writing skills; - Do not have any history of child abuse and SAY NO TO CHILD ABUSE. VII- BUDGET: The fee for this consultancy will be estimated and proposed by applicant and the bidding will be conducted among the shortlisted applicants. Consultant is expected to utilize these funds to cover every aspect of the consultancy including: tax payment, necessary travel and accommodation expenses, consultancy fee, team member salaries, per-diems, updating of DBMS, etc. CRC-Cambodia will not be responsible for any additional costs accrued by the consultant. VIII- ACCOUNTABILITY AND RESPONSIBILITIES The consultant will be accountable to the Management Team of CRC-Cambodia.
